  1. Introduction
    1.1 These Terms & Conditions (“Terms”) govern all services provided by Be4Breach, having its registered office at Greenfield Rd, Amanora Park Town, Hadapsar, Pune, Maharashtra, India.
    1.2 By engaging Be4Breach for any service, including but not limited to penetration testing, cloud security, audit & compliance, social engineering, or consulting services, you agree to be bound by these Terms.

  2. Services Provided
    2.1 Be4Breach offers cybersecurity services including, but not limited to, Phishing Simulation, Penetration Testing (Web, Mobile, IoT, API, etc.), Cloud Security, Audit & Compliance (ISO 27001, PCI DSS, SOC2 etc.), Managed Detection & Response, Forensics, Training, etc. Be4Breach
    2.2 All service deliverables will be as per the scope defined in mutually agreed proposal / contract.

  3. Proposals, Quotations & Orders
    3.1 Be4Breach will provide a written proposal / quotation based on client requirements.
    3.2 The proposal shall include scope, deliverables, fees, timeline.
    3.3 Once the client accepts proposal (in writing/email), the contract becomes binding.

  4. Payment Terms
    4.1 Payment schedule shall be as specified in the proposal or contract (advance / milestone / full payment).
    4.2 Invoices are payable within the period stated (e.g., 15–30 days) unless otherwise agreed.
    4.3 Late payments may attract interest or delay of deliverables.

  5. Client Obligations
    5.1 The Client shall provide Be4Breach access to systems, personnel, documents as required to perform the contracted services.
    5.2 The Client must ensure that all necessary legal permissions, rights, and authorizations are in place (e.g., if penetration testing external systems, consent, etc.).
    5.3 The Client is responsible for ensuring that any third-party services / vendors under the client’s control comply with required security or regulatory standards.

  6. Confidentiality & Data Security
    6.1 All data, systems, reports, vulnerabilities identified shall be treated as confidential and used only as necessary for the engagement.
    6.2 Be4Breach will store and handle sensitive / personal data in accordance with applicable law and industry-standard security practices.

  7. Limitation of Liability
    7.1 Be4Breach shall not be liable for any indirect, special, or consequential damages arising from its services.
    7.2 Be4Breach’s liability for any claim (whether in contract, tort or otherwise) shall not exceed the fees paid by the Client for the specific engagement giving rise to the claim.

  8. Intellectual Property
    8.1 Any methodologies, tools, or frameworks used by Be4Breach remain its property.
    8.2 Reports generated specifically for the Client are for the Client’s use; sharing them externally may require permission unless contract says otherwise.

  9. Cancellation & Rescheduling
    9.1 If the client requests cancellation or rescheduling, notice should be in writing.
    9.2 Be4Breach may adjust fees or apply cancellation charges depending on stage of work and incurred costs.

  10. Governing Law & Dispute Resolution
    10.1 These Terms are governed by the laws of India.
    10.2 Any disputes arising shall be resolved by arbitration or through courts in Pune, Maharashtra, unless otherwise agreed.

  11. Miscellaneous
    11.1 Force Majeure: Neither party is liable for failure due to events beyond their reasonable control (natural disaster, government action, etc.).
    11.2 Amendment: Be4Breach may update these Terms; changes will be communicated and will apply to future engagements.


Refund & Cancellation Policy – Be4Breach

  1. Scope
    Applies to all services (consulting, audits, training, etc.) procured by clients from Be4Breach.

  2. Cancellation by Client

    • More than 30 days before the commencement date → 80% refund of amount paid (after deducting any non-refundable costs).

    • 15–29 days before commencement → 50% refund.

    • Less than 15 days before commencement / No-show → No refund.

  3. Cancellation / Change by Be4Breach

    • If Be4Breach needs to cancel or postpone a service (for reasons such as resource unavailability, legal restrictions, etc.), the client is entitled to a full refund or a rescheduled service.

  4. Non-Refundable Components

    • Travel / lodging / third-party vendor costs already incurred (if any) may not be refundable.

    • Certification/exam fees, license fees, or subscriptions embedded in services which are non-refundable by the provider.

  5. Refund Process

    • Refunds will be credited to the original payment method within 30 business days of approved cancellation.

    • If refunds cannot be made to original payment source (due to bank / payment gateway constraints), alternative mutually agreed method may be used.

  6. Rescheduling

    • Client may request to reschedule services, depending on availability.

    • Rescheduling may be subject to additional fees if resources or scheduling efforts were already allocated.
